By accessing or using the Bid On Calls platform as a buyer, you agree to be bound by these Buyer Terms of Service ("Terms"). If you do not agree to these Terms, do not use the platform.
To bid on calls on the platform, you must register for a buyer account, provide accurate business and licensing information, and maintain its accuracy throughout the term of your use.
Bid On Calls reserves the right to verify your business identity, licenses, and regulatory standing before activating your account. You agree to cooperate with verification requests and to update your account when your licenses, contact information, or business status changes.
For regulated industries including insurance, legal, financial services, and home services, you represent that you hold all required licenses for the jurisdictions in which you bid on calls, and that you will bid only on calls eligible for your licensing footprint.
The Bid On Calls platform operates a real-time auction for each inbound call. Calls are awarded to the highest bidder whose bid clears any applicable reserve and whose targeting criteria match the call attributes.
By placing a bid, you are committing to pay the winning clearing price for any call you win that meets the campaign's duration threshold and is not disputed within the applicable window.
You are responsible for configuring your campaigns, including maximum bid, geo-targeting, duration threshold, and minimum intent score. Bid On Calls is not liable for calls that match your configured criteria but fail to convert.
Winning bids are billed to your account in real time and are settled according to the payment terms associated with your account (prepay, Net-15, or Net-30 as applicable).
Calls that fail to meet the campaign duration threshold are refunded automatically. For other disputes (call quality, fraud, intent-score disagreement), you may submit a dispute within 24 hours of the call. Disputes are adjudicated within 48 business hours.
You agree to comply with all applicable laws including TCPA, CCPA, CPRA, CMS marketing guidelines (for Medicare-related calls), HIPAA (for health-related calls), and bar advertising rules (for legal calls), and to use calls received through the platform in compliance with your licensing and regulatory obligations.
Bid On Calls may suspend or terminate your account for violation of these Terms, non-payment, regulatory or licensing concerns, or at its sole discretion with 30 days' notice for material business reasons.
To the maximum extent permitted by law, Bid On Calls will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from or related to your use of the platform.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of laws principles. Any disputes arising out of or related to these Terms shall be resolved in the state or federal courts located in Laramie County, Wyoming.
